**General Terms and Conditions (GTC) for renting a holiday apartment** --- ### **§ 1 Subject of the contract** 1. The landlord makes the holiday apartment available to the tenant for the period agreed in the rental agreement. 2. The holiday apartment may only be used for private, non-commercial purposes. --- ### **§ 2 Booking and conclusion of contract** 1. A booking is considered binding as soon as the tenant receives written confirmation (by email or post) from the landlord. 2. The booking confirmation creates a rental agreement between the landlord and the tenant, to which these GTC apply. 3. Minors may only rent the holiday apartment with the written consent of a parent or guardian. --- ### **§ 3 Rental price and payment conditions** 1. The agreed rental price is stated in the booking confirmation. 2. A deposit of 100% of the total amount must be paid within 1 day of booking confirmation. The remaining payment is due no later than [xx] days before arrival. 3. All prices include VAT, where applicable. 4. Additional costs (e.g. for final cleaning, bed linen or visitor's tax) are shown separately. --- ### **§ 4 Withdrawal and cancellation** 1. The tenant can withdraw from the contract at any time before the start of the rental period. The receipt of the written declaration of withdrawal by the landlord is decisive. 2. The following fees apply in the event of cancellation: - Up to 14 days before arrival: 50% of the rental price - Up to 7 days before arrival: 100% of the rental price 3. If the holiday apartment can be rented out to someone else, the cancellation fee is reduced accordingly. --- ### **§ 5 Arrival and departure** 1. The holiday apartment is available from [3:00 p.m.] on the day of arrival. 2. On the day of departure, the apartment must be vacated in a proper condition by [10:00 a.m.] at the latest. 3. A late departure can incur additional costs. --- ### **§ 6 Use of the holiday apartment** 1. The holiday apartment must be treated with care. 2. Damage caused by the tenant or his traveling companions during the stay must be reported to the landlord immediately and replaced. 3. Smoking in the apartment is FORBIDDEN / Bringing pets is only permitted with express permission. --- ### **§ 7 Liability** 1. The landlord is not liable for loss of or damage to the tenant's personal items. 2. The landlord accepts no liability for failures or impairments to the rental property caused by force majeure or external circumstances (e.g. power failure, natural disasters). --- ### **§ 8 House rules** 1. The house rules, which are displayed in the holiday apartment, are an integral part of this contract and must be observed by all tenants. 2. Disturbances of the peace and disruptive behavior that affects other residents or neighbors are to be avoided. --- ### **§ 9 Termination by the landlord** 1. The landlord can terminate the contract for good cause without notice, in particular if: - the tenant violates the house rules, - the agreed payment is not made on time, or - the holiday apartment is used for purposes other than those intended. --- ### **§ 10 Data protection** 1. The tenant's personal data will only be used to process the rental agreement and will be treated in accordance with applicable data protection laws. --- ### **§ 11 Final provisions** 1. The law of the Federal Republic of Germany applies. 2. Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected. 3. The place of jurisdiction is the landlord's place of residence.
